CONCLUSION
The Brief submitted by Wilhelm Reich to the Court of Appeals, exposed in the previous posts, was composed under circumstances of the gravest urgency.
Wilhelm Reich had declined to appear in the original court proceedings, not out of contempt for the institution, but out of a principled recognition that the court, operating within the boundaries of established legal and factual precedent, was fundamentally unequipped to judge a discovery that lay entirely outside those boundaries.
No existing legal framework held jurisdiction over the Discovery of the Orgone, or Life Energy. To submit to such a judgment would have been to implicitly legitimise the authority of an institution over territory it could not, by definition, competently evaluate.
In addition, motion to submit the documented results of Operation OROP Desert Ea as evidence, a body of Work running to some 200 pages, representing the practical demonstration of the Discovery in its most concrete and verifiable form, extending the allotted time from 7 to 60 days, in order to be able to print this Material, was denied on grounds of “frivolity”:
In 1956, printing was an entirely manual process compared to today. A 200 page document of the kind Wilhelm Reich was preparing, a legal and scientific brief with technical content, would have involved several distinct stages. The text would first need to be typeset by hand or by Linotype machine, a process that was slow and required skilled operators. Proofreading and correction would follow, then the actual printing, collating, and binding.
For a small print run of a specialised document, which this would have been, not a commercial publication with access to large printing facilities, a realistic estimate for the complete process would have been several weeks at minimum.
If the material required any technical formatting, diagrams, or precise scientific notation, that would have added further time and complexity.
Sixty days was, therefore, not an unreasonable request for obtaining, reviewing, and preparing 200 pages of printed documentary evidence in 1956. It was a practical and measured estimate of what the process actually required under the technological conditions of the time.
The government’s characterisation of that request as “frivolous” and “calculated for delay” sits poorly alongside that reality.
The documented facts, once again, speak for themselves.
The Brief was therefore an attempt to bring before the Court of Appeals what had remained submerged throughout the proceedings: the full factual background of the case, the nature of the Discovery Itself, and the unprecedented circumstances that surrounded Its suppression.
Wilhelm Reich was not appealing for leniency. He was appealing for honest examination, asking the court to recognise the absence of legal and factual precedent, and to open its doors to the evidence that would demonstrate this absence beyond dispute.
At the heart of that evidence lay something that the court, and indeed the world, had not been permitted to confront openly: that the persecution of Wilhelm Reich and his Work was not a routine legal matter, but the visible surface of a far deeper and more deliberate suppression: one that reached into the highest levels of government, military intelligence, and public health institutions, as the documents gathered in this record confirm.
The FDA spent 10 years and two millions dollars, the equivalent of 24,5 million of dollars today, in the persecution and final imprisonment against Wilhelm Reich, in order to prevent the “interstate shipment” of the Orgone Accumulator, of Which only about 300 Units were built, with an estimated value of USD 30k.
All proceedings, in any case, were invested in the furthering of the Discovery.
The question is now raised: why? why such suppression executed and imposed through a network that reached a world wide conspiracy? ……
To assume that mere material power was at the heart of the case against the Discovery, pursued by those who saw in the Discovery a real threat that would liberate humanity from the shackles of dependency, is to fall short of being legitimate holders of a consciousness that is now ready to operate at an enhanced degree of clarity and conviction, in the confirmation that the revealed records and archives expose, through a medium that has been placed at the service of humanity, at large, and without limitation, such as the world wide web, the primary purpose of which, is to grant information,not distraction, to a human race that needs to progress into higher stages of development, if planet Earth is to evolve in the Lawfulness of a Cosmic Order dictated by the Gods of Wisdom and Creation, and not fall into a parasitised state of existence as an automaton.
Planet Earth’s Living pulse can only be maintained in the dignity of a human race that operates in Freedom, not dependency, that acts in courage and integrity to protect, above all, Truth, Love, and Knowledge, opposing the lie and the comfort based on illusions that serve as a debilitating force that leads into oblivion, into an automata form of existence unworthy to be called an expression of the Gods.
The Discovery of the Orgone, or Life Energy’s Radiation as the Inception on Earth of a New Power, to be placed at the service of human evolution, as discovered and applied by Its discoverer, Wilhelm Reich, represented the biggest threat to the parasites that have taken possesion of the World, as such, they placed the whole World at their service, making use of human weakness, greed, cowardice, and love for comfort, in order to ensure that the lie held the upper hand in the battle for the Earth’s evolutive process, or its destruction.
To understand the environment within which the persecution of Wilhelm Reich’s Discovery took place, it is necessary to examine the broader institutional landscape of twentieth century America, and specifically, the concentration of private financial power that shaped that landscape across its most critical domains.
The establishment of the Rockefeller Foundation represented the most ambitious private philanthropic undertaking in recorded history. Its stated purpose was benevolent and universal, the advancement of human welfare without limitation of scope, time, country or race. The documented reality of its funding, however, tells a more specific story.
The list of institutions receiving Rockefeller funding constitutes a comprehensive map of the key pillars of American intellectual, medical, educational and social life: medical colleges, universities, research institutes, theological seminaries, education boards, and mission funds. Harvard, Yale, Johns Hopkins, Columbia, Rush Medical College, the Institute for Medical Research, the General Education Board — the reach was total and the investment was enormous.
The consequence of this concentration of funding is straightforward and requires no speculation to state. An entity that funds medical education, medical research, general education and university systems across the board simultaneously holds the capacity to shape what is taught, what is researched, what is considered scientifically legitimate, and what is dismissed, suppressed, or persecuted.
It is within this documented institutional framework that the FDA’s campaign against Wilhelm Reich, disproportionate, sustained, and ultimately fatal, must be understood.
The following is part of the section “Suppressed Documentary Evidence” from the Archives of the Orgone Institute”, where the Information sent by Wilhelm Reich to all involved in both the suppression and knowledge of the Life Energy’s Radiation’s Existence, and Its countereffects on nuclear radiation, along with the urgency to employ this Knowledge as a matter of life or death, at the service of restoration of the living process on Earth, is revealed.
As the name of the Document indicates, this information was suppressed from being exposed in Court at the trial, as part of the Documentary evidence.
Therefore, this will now be rectified and exposed as the exhibits that should have been presented in that Court where the discoverer of the Life Energy was placed on trial, for being the announcer of the Discovery of the Orgone, or Life Energy’s Radiation.

As already stated in previous posts, James C. Auchincloss (1885–1976) was a Republican congressman who represented New Jersey’s 3rd congressional district in the United States House of Representatives. He served in Congress from 1943 to 1965, making him a long-serving member of the House during the period in which this correspondence took place.
The “M.C.” after his name simply stands for Member of Congress.
He came from a prominent and well-connected family — the Auchincloss family had significant social ties within American establishment circles of the time, which makes his casual confirmation that the Surgeon General of the Public Health Service was already familiar with Wilhelm Reich’s Work all the more notable.
This was not a peripheral figure writing from the margins. This was a well-established, deeply connected member of the American political establishment, and his letter places the awareness of Wilhelm Reich’s Work firmly within the institutional core of the United States government.

Letter addressed directly to the president of the united states, General Dwight D. Eisenhower, in regards to nuclear radiation.
Context:
The date of this letter — January 2nd, 1951 — places it within the timeframe of the ORANUR Experiment, initiated in December 1950. That Experiment demonstrated the destructive intensification of atmospheric disturbance when nuclear radiation was introduced into a highly charged orgone energy environment.
This dispertion of nuclear radiation, as emanating from the Nevada nuclear test sites, would directly be placed within the West to East flow of the Orgone envelope that surrounds the Earth, thus reaching the empowered atmospheric area of Orgonon, after having been exposed to Oranur.
The results of this “confrontation” between the secondary forces emanating from nuclear radiation, and the Force of the Primary Life Energy’s Radiation, as Empowered within the frame of the Oranur Experiment, carried devastating effects, reaching world wide consequences, for an acute decaying process would be set into motion, following the Premise by Which, the Oranur Experiment, Itself, Operates. This Experiment invokes the preliminary requirement to endure an acute process of decay in that being exposed to It, before Healing takes over, securing a revival in enhancement, over a process, otherwise, subjected to decay and ultimate death.
The urgency to inform the president of the most powerful nation on Earth, at the time, Eisenhower, of this crucial Scientific fact, was based not only in the imminent event that was to take place, as the nuclear tests that were taking place, under his order, continued, but to urge him to place a stop to such nuclear tests immediately, and to halt any furthering of nuclear radiation, for the reaction of the atmospheric continuum of the planet was to be turned into a killer, in Its legitimate Right, as the Living Entity that sustains Life, to protect that living process, on Earth.
It was within the same context and at that precise time in history, as the Oranur Experiment demonstrated the degree of empowerement that the atmospheric continuum could be induced into, while this information was communicated to the President and the highest officials in place responsible for the security and protection of the nation, that the battery of atmospheric atomic nuclear test detonations started.
The reply to Wilhelm Reich’s letter, sent from the Hotel Astoria on January 9th, 1951, was written just eight days after Eisenhower himself had arrived there to establish NATO’s European command.
Wilhelm Reich’s letter to Eisenhower was originally addressed to Washington. From there it was forwarded to Paris, where Eisenhower had arrived just days earlier to establish the SHAPE Planning Group at the Hotel Astoria. The documented reply, dated January 9th, 1951 — seven days after Wilhelm Reich’s letter — confirms that the correspondence was received and acknowledged, at a moment when Eisenhower was among the most occupied military commanders in the world, presiding over the inception of what would become NATO’s central European command structure.
Such was the urgency granted to this Scientist’s information.

The above illustrations are in accordance to the movement witnessed and documented of those entities hovering above the surface of the Earth, correctly termed by Wilhelm Reich: Ea: “Energy Alpha”, indicating their mastering of the pre-atomic primordial Energy Field that surrounds the Earth and that permeates space.
The following insertion is from declassified CIA records, from witness accounts on “UFO” viewings. The character of the movement identified reveals the exact motion described by Wilhelm Reich in the forward swing motion upon which, Orgonometric Equations were based, long before the worldwide phenomena of “UFO” sightings.
Needeless to say, the publication of Such, along with the discoverer’s offering of cooperation in Its further elaboration, were denied, in the typical style exhibited by the vast majority of emotional plague ridden individuals involved in the events here being exposed: not in clear and concise communication, but in distorted, twisted, needless complicated answers attempted at evading personal responsibility:

Far from discarding Wilhelm Reich’s correspondence as paperwork forwarded from a quack who operarated from a remote place in Maine, following the narrative portrayed publicly by the same entities, his communications were carefully addressed, the responses, when granted, calculated, his information carefully classified and applied, not following the messenger’s intention, who plead for the ones in charge to place it at the service of humanity, but to serve the enemy of life.
We have now reached the conclusion of the Brief, written by the author, himself: Wilhelm Reich, a Scientist accused by the government of the most powerful nation on Earth, of promoting the Discovery of a “substance” that did not exist, while, at the same time, making use of the very same Discovery in order to seal humanity’s further evolutive state, ensuring it remains within a constant state of decay, by inducing a perpetual confrontation between the morbid character of nuclar radiation and dispertion within the atmosphere, and the Living Character of the same targetted atmospheric continuum that sustains life on planet Earth, now turned into a silent battlefield.

Eva participated in Operation OROP Desert, the last Scientific Operation that Wilhelm Reich, her father, was allowed to conduct, before being incarcerated, in the quality of an assistant, a nurse and a witness, while keeping written records of the extraordinary events she witnessed during those last crucial months.

A “Writ of Certiorari” is a plea to have the Case revised by the Supreme Court providing documentary evidence that might have, otherwise, been suppressed, as it was the case in this instance.
Under the three cases listed above that would have granted the hearing of the case, the following can, and should, be stated:
The case had, not national, but Planetary significance, since it was none other than the Discovery of the Appearance of a New Influence on Earth, carrying the necessary Healing and Evolutionary Impulses, in order so that the correct development of the human race, is achieved. Not nations, but the whole Earth, was involved in the case.
The clarification of the case would have harmonized the numerous conflicts and inconsistencies raised, of necessity, by a fradulent system of justice, directed by lies, deception and corruption. Truth would have brought to Light, the enormous deception being perpetrated, against humanity.
The precedent value of reviewing the case and granting the duty of facts to reveal the suppressed Truth would have changed the course of human evolution, allowing for the progress of the race’s development, based on Truth, to become a Reality.
Progress based on Freedom, Truth and Reality, not dependency, illness and illusions, belongs within the correct evolutionary path designed for the human race, placing us within the stream of an evolutionary process that has earned the eternal value of immortality.
Progress based on Freedom, Truth and Reality, can only take place in the Knowledge, Assimilation and Harmonization of human existence under the Influence of Something Higher, more Powerful, of a Healing Character, capable to ignite what has been deemed to decay, back into the dignity of a human existence that acts in the courage, health and freedom designed by the very Gods of Wisdom and Creation
Continuation of the further points of conclusion by Wilhelm Reich. Point 1:

Safety and independence of basic natural science should be the pillars of a society whose very basic development relies on the innate right and duty of each individual to expand his or her horizons, from a basic state of existence to a further stage of constant development, in the dignity that knowledge grants the one who seeks, who investigates, who works to obtain answers to mysteries waiting to be revealed by means of human deed.
Any form of control over new discoveries, that decides what is considered “acceptable”, by a system of government that employs its authority to restrict what is reachable to the citizens under its governance, and what is to be widely disseminated and enforced, is an authoritarian system of government, whether it is clothed under the designation of a democracy, or fascism, it is just that, a designation, its core principle is based on authoritarinism, deciding on behalf of the individual, what is to be promoted and instigated, and what is to be suppressed, hidden.
Point 2, where the side handwritten note reads: “goes right on”.
Mankind’s basic rights are the rights to know, to investigate, to expand the horizons of knowledge beyond what is of immediate availability to the senses, for the phenomena that hits those senses that have not been refined in the capacity for analysis and clarification, is of an illusory, fabricated, manipulated nature, done so by the very forces that restrict knowledge, beyond an ordinary act of will to attain It.
To place a court of justice that is directed by conspiratorial forces, forces that deny and forbid human evolution, in charge of deciding what is, and what is not, Knowledge of future generations, is an act of treason against humanity.
The following note on point 3 reads: “Supreme Court is Red” — a reference to communist ties within a subversive form of government operating under the guise of democracy.
Within the same historical timeframe encompassing these events — the inception of the Discovery of the Life Energy and the inception of the atomic bomb and its radiation dispersal — the degree of communist infiltration into the highest offices of the United States had become so grave a problem that measures were deemed necessary to halt its further spread into the uppermost positions of government. The consequences of failing to do so carried a risk of the most profound order: the transformation of a nation founded upon individual freedom into its very opposite: a nation whose form of government would no longer rest upon the liberty of the individual, but upon the dependency of the masses upon the state.
The most prominent investigator, exposer and denouncer of the extent of communist infiltration already embedded within the government, reaching to its highest officials, was Senator Joseph McCarthy. He was disciplined, censored and removed from his position shortly before he was about to reveal and expose the names of high-ranking White House officials with subversive ties to the communist party, with all the profound implications such revelations carried: a nation presenting itself as a democracy, while in reality being governed by a small number of powerful individuals who determined the course of every dimension of human endeavour its citizens would be subjected to. These few would decide who ascended to the presidency, who presided over the courts of law, what disciplines would be taught in universities, what system of education the people would be exposed to, what form of medicine would be permitted, and so forth. All the while, those subjected to this authoritarianism were made to believe they were living under a democracy.
This is the context within which Eva Reich wrote her marginal note: “The Supreme Court is Red.” Confirmation of this assertion can be found in the documentary book Blacklisted by History by Stanton Evans.
Senator McCarthy was officially pronounced dead due to complications arising from alcoholism — or so the official narrative would have it. Needless to say, this account of Senator McCarthy’s untimely death was yet another slander, another lie, another calculated attempt to silence the Truth.
The final point carries the most profound and urgent plea of all, a plea for the case to be reviewed, and for the Documentation that was never permitted to see the light of day: “Operation OROP Desert”, to be examined by the highest officials appointed to sit in judgement over the case of the United States against the Discovery of the Life Energy. Yet the time required to prepare the Documented Scientific evidence compiled in Operation OROP Desert was never granted. The evidence was denied presentation. The Truth was suppressed by a system held in the grip of powerful interests implacably opposed to human evolution.
The written words as a side note by Eva Reich, daughter, laboratory assistant and faithful witness to the events that took place during Operation OROP Desert in Tucson, read: “never reviewed”, in relation to the Documentation recorded during that Scientific Expedition, followed by “conspiracy of SILENCE re spaceship problem continues”, regarding the scientifically proven presence of forms of existence alien to planet Earth, abiding within the planet’s atmospheric process, as Documented in OROP Desert, the revelation of which, was never allowed to see the light, being suppressed and placed under absolute secrecy, to the point of bringing the case against the Discovery of the Life Energy, as the ultimate proof upon which the existence of these “alien forms of existence” can be demonstrated, to stand as a Defendant, along with Its discoverer, on grounds of being non existent, accused by the most powerful nation on Earth.
One estimates the value of a Subject under attack by the measure of the forces trying to destroy It.
The last words read:
Our planet Earth, is, indeed, in deep trouble, as written 70 years ago by the scientist who discovered the Existence of the “Element” that grants life on Earth, the value of a vibrant process worth being called “living”, elevated beyond a mere state of “existence”.
Eva added the word ‘Amen’ after the statement, a single word that transcends commentary, carrying within it the full weight of a solemn and unshakeable affimation of Truth.
These posts have methodically set forth each and every reason why the case brought against the Discovery of the Life Energy was, and remains, illegal. Wilhelm Reich took meticulous care to document every fact pertaining to the illegitimate nature of the injunction, exposing it for what it truly was: a fraudulent act of treason, directed not against the Discovery itself, nor against him personally, but against the human race as a whole.
The significance of what was at stake in the case brought against the Discovery of the Life Energy’s Radiation surpasses what can be grasped from any personal perspective, even armed with the necessary knowledge drawn from archived and declassified documentation. The case raised by the most powerful government on Earth against the Discovery of the Life Energy’s Radiation cannot be understood through the ordinary lens of good versus evil. It must be approached from the only standpoint that affords a complete and unobstructed view of what truly took place:
The deliberate halting of human evolution.

“Living” conveys development, in a free individualistic act of will, if the condition of being “human” is worth being called as such.
This act of Will into higher stages of evolution is a duty, as heirs of planet Earth.
Development in the absence of health, courage and strength can hardly be sustained in a constant state of decay and survival, yet, decay and dependency is the premise and predicament under which we stand today.
Wilhelm Reich knew the monstrous character of the forces standing against him, yet he did not submit to them, he denied them a right they did not hold: the right to judge the Discovery of the Life Energy’s Radiation.
It is thanks to his courage, determination and relentless adherance to Truth, that these words may today be written in the objective clarity of archives and records resurfaced and exposed via this medium.
As long as one single soul finds the way to this Testimoy, evolution will find a way to continue within the Mighty Deed decreed for humanity: to carry Earth’s evolutionary state into higher stages of development, in the dignity of Love, Truth, and Knowledge.
